Court stops replacement of Rigathi Gachagua as deputy president

to update: The Supreme Court issued interim orders halting Regathi Gachagwa’s replacement as Vice President until October 24 when the matter will be mentioned before a bench appointed by Chief Justice Comey.

Impeached Vice President, Rigate Gachagwa, has moved to court to challenge his removal from office by Parliament.

Through lawyer Paul Moeti, Mr Gachagwa also sought court orders to prevent President William Ruto from nominating his successor, pending the determination of his case.

Mr. Gachagwa has challenged the entire process that led to his impeachment, arguing that the charges against him were baseless and that the evidence presented before Parliament was insufficient.

“False and baseless accusations have been made against me in the impeachment petition before both chambers. It will be in the interest of justice to correct this false information in line with the provisions of Article 35 of the Constitution,” he said.

Mr. Gachagua says the Senate is required by law to act as a neutral arbiter in considering whether the accusations before it have been proven.

He asserts that the evidence used to form the basis for his dismissal was insufficient.

“It would be prejudicial to my client to allow the respondents to gazettate his dismissal by charging in a manner inconsistent with fundamental constitutional provisions before this petition is heard and decided,” Moeti said.
