Netlist (OTCQB: NLST) has lost its appeal in a patent validity investigation with the US Patent and Trademark Office that argued that Google (GOOGL) was an interested party to a patent dispute with Samsung Electronics (OTCPK: SSNLF).
Google is not a “real party”. interest” in the matter, according to a filing from the USPTO on Friday.
PTO Director Cathy Vidal was assessing whether Google (GOOGL), a supplier to Samsung, was a true party of interest in a dispute over Patent 912. If it had been determined that Google was a true party of interest, then Samsung would have been barred from the proceedings, making I mean, they filed their intellectual property rights too late.
“We are pleased that Director Vidal brought this request up to her review and hope the board takes a close look at all the facts supporting the Samsung and Google relationship,” Netlist CEO CK Hong said during the memory company’s fourth-quarter earnings call in February. .
Netlist (OTCQB:NLST) did not immediately respond to Alpha’s email request for comment after normal business hours.
The request from Netlist (OTCQB: NLST) to look into the relationship between Google (GOOGL) and Samsung (OTCPK: SSNLF) came after the USPTO said in late October that it would review Claim 16 in the 912 patent dispute. The board said at the time that Samsung “has shown a reasonable probability” that the claim will be found to be false.
The patent infringement claim relates to printed circuit boards, dual-date memory and memory modules, or DDR.
