Maasai Mara University has filed a lawsuit seeking to recover Sh215 million from its former vice chancellor, Mary Walengo, whom it accuses of obtaining the money through corruption.
In a suit filed at the High Court in Narok, the university alleges that between June 2017 and September 2019, Professor Walengo ordered large sums of money to be withdrawn from the university’s bank accounts.
She has not responded to the case yet.
Corruption proceeds
“This honourable court is pleased to declare that the amount withdrawn by the defendant from his bank accounts, amounting to Sh215 million, is proceeds of corruption,” the university said in its court filings.
“The Honourable Court is pleased to order that the above mentioned funds amounting to Shs215 million which were illegally misappropriated by the defendant be returned and/or restituted to the first plaintiff (the University).”
Masai Mara also asked the court to order the seizure of the defendant’s assets as an alternative to praying for the recovery of the money.
The university said Professor Walingo was charged in a criminal court, but the case was dismissed after a judicial review order was issued.
The Foundation added that the expiry of the criminal case does not exonerate the accused, who was accused of receiving money in exchange for goods and/or services that were not provided.
New case
The university says in the new case the accused withdrew Sh7.9 million from Barclays Bank (now Absa), Sh9.6 million from KCB Bank, Sh37 million from National Bank, Sh79.7 million from Equity Bank and Sh80.7 million from three different accounts at Cooperative Bank.
Masai Mara said investigations revealed that Prof Walengo organised a series of people to assist her in the corruption, including finance officials, treasurers and other staff in the finance department.
