Priest Ng’ang’a receives orders against the railways in the city’s land dispute

Televangelist James Nganga of the Nino Evangelical Church has obtained orders preventing the Kenya Railways Company (KRC) from interfering with a plot of land on Haile Selassie Street that is alleged to be a railway reserve.

The preacher sought court protection after the government corporation halted his plans to build a commercial building on the property.

Reverend Nganga said in court documents that, being the legal owner, he had drawn up plans to build 20 shops, parking spaces and other social facilities on the plot of land.

The Environment and Land Court judge, Edward Waputuo, granted interim orders to Mr Nganga, preventing the KRC from interfering with his title and the quiet and peaceful enjoyment of the piece of land, pending a decision on the application.

“In giving notice to the defendant/defendant of the proposed construction, he/she has shown manifest intent to force, unlawfully and without any justification or color of right to transfer, dispose of or transfer the said plot of land, alleging that it is a railway protectorate.” Ng’ang’a said in the application.

Judge Waputuo directed the case to be heard on July 4.

Through attorney Cliff Odok, Reverend Nganga said he is the legal and absolute owner of the land after he acquired it from a couple for Sh8 million on June 22, 2011.

He said the previous owner was Amin Muhammad Rahim Banji, who had a 99-year lease from October 1994.

After the death of Mr. Bhanjee, Certificate of Confirmation of Grant was obtained by his wife Farida Amin Muhammad after succession issue on 17th July 1998.

Rev. Nganga said he purchased the land after conducting due diligence at the Land Office, who confirmed that the title to the property was genuine.
