President William Ruto named Central Organization of Trade Unions (KOTO) President Francis Atoli as part of a seven-member selection committee tasked with overseeing the appointment of the country’s next Director of Public Prosecutions (DPP), a post that remained vacant after Nureddin Haji. He was chosen to head the National Intelligence Service.

The panel, which also includes the Ethics and Anti-Corruption Authority (EACC) CEO Talib Mubarak, was disclosed via a June 21 private newspaper notice.

The others are Mary Kimoni (Public Service Principal Secretary), Shadrak Moss (Solicitor General), Mary Adhiambo (Public Service, Department of Human Resources and Development Secretary), Roslyn Odede (Chairman of the Kenya National Human Rights Commission) and Richard Obucha.

The Committee is expected to identify and recommend suitable candidates to the Chair for appointment.

Then the president nominates one person and sends the name to the National Audit Association, if approved, the nominee is appointed by the head of state.

The Constitution of Kenya provides for the same qualifications for appointment as Director of Public Prosecutions as for a High Court judge.

Article 157, Clause 5 of the Supreme Law states, “The Chief of Public Prosecutions shall hold office for a period of eight years and may not be reappointed.”

The start of the recruitment process comes just a week after Mr. Haji was sworn in on June 14 to head the spy agency.

As the country’s second Deputy Chief Public Prosecutor since 2018, Mr Haji came under fire after the 2022 elections for the rampant withdrawal of high-profile court cases with a cumulative value of Sh10 billion. The daily business analysis.
