The response of the Government of The Bahamas will determine whether it continues or drops certain cases.
Sam Bankman-Fried was captured last year in the Bahamas and subsequently transferred to the United States. The allegations against him include multiple counts of financial fraud and the collapse of FTX. Bankman-Fried has been accused of engaging in illegal activities, including allegedly working with former FTX executives to persuade US lawmakers to pass legislation that would benefit FTX. In carrying out these allegedly illegal actions, he managed to exceed the maximum contribution amounts allowed by law. He was thus accused of making illegal political contributions and bank fraud.
In addition, Bankman-Fried has been charged with crimes related to paying a foreign government to unfreeze brokerage accounts associated with its hedge fund, money laundering, and running an unauthorized money transfer operation, among other things.
The attorney argues to dismiss 10 of Bankman-Fried’s 13 charges
However, Bankman-Fried’s legal counsel took action by filing a motion with the United States court to dismiss the charges against him. According to his lawyer, many crimes were not sufficiently defined. Bankman-Fried currently faces a total of 13 charges, all of which he has pleaded not guilty to. In addition, his attorney is specifically seeking ten of those charges to be dismissed.
Former CEO’s attorney too Claims that in the circumstances surrounding the treaty between the United States and the Bahamas governing his extradition he could only be prosecuted on the specific grounds for which his extradition was made. The US government allegedly added unrelated criminal charges and new items without the Bahamas government’s approval. As a result, the defense finds that these new proposals should be rejected.
The US government went on to state that, at this point in the case, there is no justification for dropping any of the charges. The Department of Justice stated that there are no restrictions on filing new charges against a defendant after his extradition under the terms of the agreement between the United States and the Bahamas.
However, it is recognized that The Bahamas has the authority to waive certain post-delivery clauses. In light of this, the US Department of Justice is currently seeking a waiver from the Government of The Bahamas in order to advance certain aspects of the cases. The course of action will ultimately depend on how the Bahamas government responds. The fee will go ahead as planned if the Bahamas government agrees to a waiver. If the waiver is denied, on the other hand, the US Department of Justice will be forced to drop the new cases and focus solely on the charges that prompted Bankman Fried to extradite him.
On June 15, a court hearing will be held to discuss the motion asking for 10 of Bankman-Fried’s 13 counts to be dismissed. The outcome of this procedure will have a significant impact on how the case turns out.
